Recently, the Las Vegas Review Journal petitioned the Court to allow access to certain evidence that would be used against the Defendants.  They even asserted that they would have no problem if names were omitted from the documents.  This was filed in response to the government’s Proposed Protective Order, a request that the Court seal and keep from the public some of the discovery materials, certain evidentiary documents, and exhibits that could be used in the trial against the Defendants.  Quite simply, it is all of the evidence acquired by the government in their pursuit of the persecution of 19 people that were involved in the Bundy Ranch Affair, nearly two years before the matter was indicted by a Grand Jury.  The Court has yet to rule on the matter.

Before we proceed, the discovery material would show what the government did, what they acquired, what their practices are, and whether they had subversive agents embedded within the group that afforded protection to the Bundy Ranch in April 2014.

As you follow along in pursuit of the government’s position, and the legal precedence, some of it even distorted perversions regarding the original intent of the Founders, also keep in mind that, historically, spies and entrapment were used against enemies, and spies against foreign governments, but never sent within the population that was supposed to be protected by that government.  For, to do so essentially, makes the people an enemy of the government, or, rather, the government the enemy of the people.

So, let’s look at what the Supreme Court has said, with regard to the Sixth Amendment.

In 1979, the United States Supreme Court, in Gannett Co. v. DePasquale, 443 US 368, addressed whether the press and public could be denied access to the court and evidence in a pre-trial hearing.  Although the decision was based solely (and rightfully) on a pre-trial hearing, the decision of the Court ventured further into the entire concept of the intent and purpose of a “public trial”, as guaranteed by the Sixth Amendment:

In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining Witnesses in his favor, and to have the assistance of counsel for his defence.

The Petitioner, Gannett Co., is a publisher and among others, published USA Today.  Greathouse and Jones were defendants in a state prosecution for second-degree murder, robbery, and grand larceny.  They requested that the public and the press be excluded from the hearing, arguing that the unabated buildup of adverse publicity had jeopardized their ability to receive a fair trial.  The trial judge granted the motion.  The following are excerpts from that decision:

Petitioner [Gannett] then moved to have the closure order set aside but the trial judge, after a hearing, refused to vacate the order or grant petitioner immediate access to the transcript, ruling that the interest of the press and the public was outweighed by the defendants’ right to a fair trial.

The New York Court of Appeals… [held] the exclusion of the press and the public from the pretrial proceeding.

The Constitution does not give petitioner [Gannett] an affirmative right of access to the pretrial proceeding, all the participants in the litigation having agreed that it should be closed to protect the fair-trial rights of the defendants.

Publicity concerning pretrial suppression hearings poses special risks of unfairness because it may influence public opinion against a defendant and inform potential jurors of inculpatory information wholly inadmissible at the actual trial.

The Sixth Amendment’s guarantee of a public trial is for the benefit of the defendant alone.  The Constitution nowhere mentions any right of access to a criminal trial on the part of the public.  While there is a strong societal interest in public trials, nevertheless members of the public do not have an enforceable right to a public trial that can be asserted independently of the parties in the litigation.  The adversary system of criminal justice is premised upon the proposition that the public interest is fully protected by the participants in the litigation. So far, ten of those charged in United States v. Ammon Bundy, et al, have pled guilty, and the eleventh is soon to follow. They are, as follows:

  • Jason Blomgren (Joker J), pleaded guilty to a federal conspiracy charge.
  • Brian Cavalier (Booda), pleaded guilty to a federal conspiracy charge and a charge of possessing firearms or dangerous weapons in a federal facility.
  • Blaine Cooper, pleaded guilty to a federal conspiracy charge.
  • Travis Cox, pleaded guilty to a federal conspiracy charge.
  • Eric Flores, pleaded guilty to a federal conspiracy charge.
  • Wesley Kjar, pleaded guilty to a federal conspiracy
  • Corey Lequieu, pleaded guilty to a federal conspiracy charge.
  • Joseph O’Shaughnessy, pleaded guilty to a federal conspiracy
  • Ryan Payne, pleaded guilty to a federal conspiracy charge.
  • Geoffrey Stanek, pleaded guilty to a federal conspiracy charge.

So, why are they pleading? Is it because they really think that they are guilty?

Most, if not all, of those above have been “intimidated” or “threatened“, by federal prosecutors, either directly, or through their appointed counsel, that a Terrorism Enhancement could result in a sentence of 30 years, possibly for each count.

For a little background, over twenty years ago, I reported on a trial (see below) that I would eventually learn to be one where the Federal Sentencing Guidelines had brought into our judicial system something that was very foreign to the system of justice, as implemented by the Founders. Perhaps it would be beneficial to begin with an understanding of the judicial system that was intended, based upon many centuries of evolution in the British Common Law.

The English Constitution, even before the Magna Carta (1215 AD), began evolving in 1080 AD, and was also the beginning of a legal evolutionary process that sometimes went backwards, but most often went forward, in an effort to provide justice rather than blind obedience to laws. It was the English Common Law that was the foundation of jurisprudence for the Founders.

This foundation is evidenced even in current statutes, such as Florida Statutes (2015), where we find:

2.01 Common law and certain statutes declared in force.—The common and statute laws of England which are of a general and not a local nature, with the exception hereinafter mentioned, down to the 4th day of July, 1776, are declared to be of force in this state; provided, the said statutes and common law be not inconsistent with the Constitution and laws of the United States and the acts of the Legislature of this state.

We can also look to the Maryland Constitution (2008), which provides, in its Declaration of Rights:

Art. 5. (a)
(1) That the Inhabitants of Maryland are entitled to the Common Law of England, and the trial by Jury, according to the course of that Law, and to the benefit of such of the English statutes as existed on the Fourth day of July, seventeen hundred and seventy-six; and which, by experience, have been found applicable to their local and other circumstances, and have been introduced, used and practiced by the Courts of Law or Equity…

In the same Declaration of Rights, we also find:

Art. 23. In the trial of all criminal cases, the Jury shall be the Judges of Law, as well as of fact, except that the Court may pass upon the sufficiency of the evidence to sustain a conviction.

Now, the Maryland Constitution predates the United States Constitution, as it was first ratified by the People on November 11, 1776 – over a decade before the Constitution. Clearly, the understanding (original intent) of the Maryland Constitution and the United States Constitution were predicated upon those laws that then existed, and definition, or intent, of the words used, were as they were understood at the time. Absent a lawful change of definition, those definitions and intentions are still the body of the law and should be recognized as such.

Also true of the Common Law, at that time, and remember, the intention is still the same, is that a jury determines law and fact. However, there is one more aspect that comes into play. The jury also imposed the sentence, as they were the judge of facts, those which determined the severity of the crime; the law, what was intended and the extent applicable to the case at hand; and, by combining the two, would determine the sentence to be imposed, if the accused were found to be guilty.

In light of the many complaints filed against the Arnold Law Firm, attorneys for Ammon Bundy, over their method of raising funds to pay for a legal defense against a government back by hundreds of attorneys and millions of dollars, perhaps there is another side to this story that needs to be looked at.

Shawna Cox had the wherewithal to begin recording the events, from the first stop to the murder of LaVoy Finicum.  In so doing, she recorded a moment of history that cannot be duplicated.

We all know that if you are in a position to have exclusive footage of an event of such magnitude, there is some value, to some news agencies, for exclusive use of such footage.  How often have you seen “Exclusive to XYZ News”, or something similar?  Well, it would not be “exclusive” if it were freely put out in the public domain, for the use of all. Is it for the government to interpret the Constitution, or is it for We, the People, to interpret that document, which, as is so clearly stated in the preamble, approved by us, through conventions of representatives in all thirteen then independent states under the Articles of Confederation?

There can be little doubt that Congress, the Executive, and the Judicial, must, in many instances, determine the intent of the Constitution.  The same was true under British rule.  However, when the government interpretation reaches the point of a gross deviation from intent, we cannot leave it to the government for that interpretation.  For, to do so allows the government to bypass the Amendment Process described in Article 5, and simply pass whatever laws they want.  When that happens, the Constitution is no longer in effect, and we are subjected to nothing less than a despotic government, failing to be government created by the Constitution, rather acting as an oligarchy, with no regard to the limitations imposed upon them by the Constitution.

So, in a larger sense, it must evolve to us, when the government so grossly misapplies those powers and authorities granted to it by the Constitution, to take, again, the reins of government, and to force those who claim to represent us back into their limited authority, by whatever means necessary.

The events in Harney County, Oregon, have brought a rather interesting light upon the actions of government.  So, we will begin by comparing some of their actions to historically recognized abuses, and then the remedies evolving out of those prior violations of our natural rights. William Wolf was convicted of having an unregistered firearm, that firearm being a machine gun and a shotgun having a barrel of less than 18 inches in length.

In a couple of previous articles (The Setup and The Entrapment) some of the circumstances surrounding Wolf’s being targeted and entrapped were addressed. However, those were written before his trial.

The Judge, in this case, was Susan P. Waters. She has been an instrument of “obstruction”, throughout. Apparently, she places herself, with the aid of the law, above justice.

During the trial, additional evidence of outright lies by the prosecutor’s witnesses have come to light, as explained in the following letter that Wolf has gotten out to us. The letter was transcribed from a written copy, and is exactly as written:

The trial of William Krisstofer Wolf has culminated in three facts; the paid informant and Gray’s testimony and the infringement on free speech and a fair and impartial trial.

On December 18, 2014, in a debriefing of a recorded meeting, in Four Corners, Montana, the paid informant, Ed Gray, made the statement. I wanted a “Russian fully automatic shotgun, specifically a Saiga.”

That recorded meeting, by the FBI agent Greg Rogers, as entered into evidence, has NO such statement. In 22 months of FBI recorded statements, I ONLY ever request a “Russian automatic shotgun.” That is not an illegal request. If it were the, model 1911 .45 ACP, the old Army .45, would be illegal because the letters ACP stand for automatic colt pistol, which is NOT a fully automatic pistol. It is still used and sold today with no permits.

However, in those 22 months of FBI recorded conversations and meetings, there is NEVER a mention of a “Russian fully automatic shotgun, specifically a Saiga.” Therefore, the statement made by Ed Gray in the debriefing on December 18, 2014, can ONLY result in one conclusion; Ed Gray and I had a unrecorded conversations; NO audio exists of me mentioning a “Sega fully automatic,” yet on audio and testimony, Rogers and Gray say I do.

This evidence is supported by telephonic records, I asked my defense team to subpoena, that would prove there were unrecorded conversations. However, Ed Gray, on the stand, under oath, testified that there were no unrecorded conversations or meetings. As Gray testified that on December 18, 2014, I told he AND Agent Greg Rogers, I wanted a Russian Saiga fully automatic shotgun. The recording prove that testimony in the statement on December 18, 2014 debriefing, to be a direct lie under oath. Unrecorded deals defining conversations violate the wiretap rules.

The prevailing reason for my conviction is based on the verifiable, undisputed, recorded, perjurious testimony and debriefing statement by Ed Gray, which is paramount to Derivative Entrapment. This renders Ed Gray’s testimony uncredible and inadmissible.

To cover for the uncredible testimony and debriefing of Ed Gray, the Department of Justice, repeatedly presented testimony and evidence to establish a proclivity toward my bad character. However, FBI documents and recordings CLEARLY show that I had NO proclivity or predisposition to commit a crime. As a matter of FBI documents and recorded fact, it clearly shows that the FBI, through various informants, intended to induce me to commit the crime of manufacturing and distributing grenades, rocket propellant, RPGs, and explosives, as well as helping an FBI informant to acquire a Glock P18 fully automatic pistol.

I responded, on an FBI recording, that there was no need for a fully automatic weapon. This recorded statement establishes two things; one, I know the difference between a fully automatic and an automatic. Secondly, it clearly establishes that I had NO proclivity or predisposition to purchase and/or commit an illegal act of owning a fully automatic.

This harmful error occurred with the repeated inclusion of testimony and evidence by the Department of Justice, ultimately the exposing the jury to evidence that was persuasive, but inadmissible that it SO aroused the emotions of the jury, that calm and logical reasoning was abandoned; creating a biased and prejudicial jury, thereby denying me a Constitutionally protected fair and impartial trial.

That immaterial, irrelevant, harmful evidence and testimony created under prejudice, which caused my defense team to spend 500 hours trying to review for my defense.

However, this harmful, immaterial, irrelevant testimony, attacking my freedom of speech, expression, assembly with like-minded people, freedom of the press, and my right to redress of grievances without interference, infringement, or restriction by the government or government intervention, is Protected by Article 1 of the Bill of Rights.

Yet the agencies of the federal government did exactly that, as testified to by FBI agent Matt Deurmeir’s 25 month investigation and subsequently the Department of Justice’s introduction of my political views on government corruption; specifically, abuse of power, judicial and political misconduct, items that are not illegal to own or the historical and potential current or future use or open discussion, namely a flamethrower, my very lawful and constitutional redress of grievances and my views and opinions of current and potential futuristic patriotic events.

These Protected rights are NOT derived from recent groups like the Black Panthers, chanting, “pigs in blankets, fry them, like bacon,” which is a direct reference to flamethrowers and their hypothetical use; or Black Lives Matter, who said, “if you don’t start holding yourself accountable more like this will happen,” in reference to the execution style murder of a sheriff; or Louis Farrakhan: calling for 10,000 young men to do what is necessary; or Rev. Al Sharpton leading a chant in Ferguson, Missouri of “what do we want? Dead cops. When do we want it? Now,” who then gets invited to the White House for dinner. These Protected rights are derived from the founding documents; I quote:

“In every stage of these oppressions we have petitioned for redress in the most humble terms. A repeated petitions have been answered by repeated injury… We have warned them from time to time of attempt by their legislature to extend an unwarrantable jurisdiction over us… That whenever any form of government becomes destructive of these ends, it is the Right of the People to alter or abolish it, and to institute new government. But when a long train of abuses and usurpations, pursuing invariably the same object evinces a design to reduce them under absolute despotism, it is their right, it is their duty, to throw off such governments and to provide new guards for their future security.”

Black’s law is very clear on a Right where a corresponding Duty is invoked. All the exercise of my free speech, that the Department of Justice used against me to prejudice the jury, is derived from that founding document unanimously declared on July 4, 1776. It is the Declaration of Independence, and it is the bedrock of America. You may not like what I have to say, that is my Protected Right, and shall not be infringed.

The use of this inflammatory, irrelevant, and immaterial testimony, along with the fact that agent Greg Rogers, as recorded by the FBI, NEVER definitively expressed that the firearm was fully automatic and only inferred that a fully automatic was illegal; in fact he went to the extent of invoking that the firearm was legally converted, not inverted, by have registered, licensed and federally regulated Class III dealer, conclusively bases actions Entrapment by Estoppel, thereby resulting in an illegal arrest. That action resulted in a prejudicial and unimpartial jury.

The facts, as evident in the FBI documents along with many others my defense team could not bring forth due to the 500 plus hours spent trying to prepare a defense against irrelevant, immaterial, harmful, and ultimately prejudicial testimony, as well as the proven lies under the oath of Ed Gray, deprive me of a constitutionally protected right to a fair and impartial trial.

This obvious harmful error can and should be corrected by this court. This very instant in compliance with its oath to protect and uphold the Constitution, as affirmed in the 1803 Marbury v. Madison ruling and not passed over, ultimately turning this into a manifested Constitutional error, to a higher court.

I unequivocally declare my innocence in this matter and continue to maintain I was entrapped and ultimately denied a fair and impartial trial amounting to a Political Persecution because of the exercise of my free speech as targeted by the FBI.

Schuyler Pyatte Barbeau is accused of failing to pay a tax and register a firearm with the federal government and that required that the tax be paid. However, the “firearm” was not a “firearm”, but separate parts, when the government received it, as explained in “The Arrest of Schuyler Barbeau“. There were two barrels, a receiver, optical devices, and other items, in a case that was delivered to a Confidential Human Source (CHS), identified as Oliver Murphy.

Now, it is necessary to understand that all of the objects that were in that case were legally purchased. There is no crime in the possession of the objects. However, it is rather ironic that if the shorter barrel (10.5 inches long) is affixed to a rifle receiver, it becomes illegal, presumably, because the rifle with a barrel less than 16 inches (the “criminal” element), can be easily concealed because of the short length. The 10.5 inch barrel reduces both muzzle velocity and accuracy, when fired, so it is really less of a rifle. On the other hand, if you were to affix the 10.5 inch barrel to a pistol, or handgun receiver, it is legal. In contrast, the rifle receiver, which by description, must have a stock, while the pistol receiver does not. This makes the pistol with the 10.5 inch barrel considerably shorter, and more concealable, than the rifle version. So, it begs the question, is there any sense, at all, in this law that taxes the one (rifle) and not the other (pistol)?

So, now we have illustrated the extent of the charges against Barbeau. Clearly, this is about his demonization by the federal government, in an attempt to influence public opinion against Barbeau, because the law does not allow “fishing expeditions” to try to find a crime, nor did the Framers intend for the government to have such power.

The demonization begins with the information provided by the paid CHS. This is detailed in “Search Warrant Affidavit or Fishing License“. There are unsubstantiated claims that Barbeau claimed to have stolen “blasting caps and detonation cord” from his Army National Guard unit, though there is no indication that the well inventoried and secured items were ever stolen, nor were they found during the warranted search.

To understand the security involved in cataloging these items on a military installation, here is what Maureen Peltier, a disabled 15 year veteran that worked in supply, says about the control of such inventory:

I must add information for those not privy to our supply handling of certain equipment.
Soldiers, we all know Ammo, blasting caps, det cord are not just laying around in our Armories. We all have to go to ASP (Ammo Supply Point) to receive and only those authorized with specific Ammo handlers certification can sign out for such items for scheduled training. Transportation to and from Armory than to training site is all pre-determined. Much coordination is involved and I personally have overseen such coordination as I have in my logistics positions, coordinated from pre-planning to execution to return. Such items are handled under guard and with great caution. Storage points at Armories, just prior to live training execution, would be under weapons vault controlled by unit Supply Sergeants. Security alarm systems and a vault room inside larger weapons vault room is the proper authorized site until final movement to a designated training site.

If items such as that went ‘missing’, they would not only shut down and lock down all of the surrounding area or entire base, Soldiers would all be confined to unit AO or training site, until all missing items are recovered or an all clear by base Commanders have been issued. This would not go unnoticed. ~SSG Moe

However, when the FBI visited the National Guard unit, the only thing they had to say was that Barbeau had served eight honorable years in both the Marines and Army National Guard. There was no evidence to support the loss of the named items.

This, however, did not bar the FBI from “invading” the Aenk Ranch, some 280 miles from where Barbeau was arrested. This raid was a quasi-military operation, conducted by 25 goons, each using the same type of firearm that Barbeau is accused of possessing, and numerous other federal agents, as shown in video footage of the raid in “Domestic Terrorism“.

This raid was based on the very vague charges in violation of Title 18 (Criminal) US Code. Charges of possession of stolen federal property and possession of a machine gun. Neither of these charges have any substance, as explained above, except for the word of the paid CHS informant. So, again, it begs the question, were the “allegations” made by the paid informant simply an imaginary and contrived scenario to please those who were going to cut him a check for $3,500, or just bravado talk between friends?

Later, news channel, King 5, on December 17, did a field interview with Allen Aenk, where the damages caused by the December 6 raid on the Aenk Ranch can be seen. The segment also shows a portion of a document that had been recently unsealed at the Federal Eastern District Court, in Spokane, though not tied to the arrest and current charges against Schuyler Barbeau.

The referred to document, the affidavit supporting the search warrant that was executed on the Ranch of December 6, brings forward the additional unsubstantiated charges of violation of the criminal code.

It is important to note, since there is no proof of stolen property, it is reasonable to question, how can it be justification for such an overwhelming show of force when the nearly platoon sized army of federal agents stormed the ranch, knowing that, with the exception of Carrie Aenk who was alone at home, the other two inhabitants of the property were in federal hands, 280 miles away?

The raid, based upon such meager justification, surely cost the taxpayers many thousands of dollars, which makes us ponder whether the intent of the law is, as suggested, a tax or revenue law, or is it an expansion of federal authority, outside of the constraints of the Constitution, in trying to circumvent the Second Amendment?

We are not yet finished with this story. There is little doubt that public disclosure of the raid did bring to the forefront the (obscure) possibility of criminal acts. That, of course, would produce a high degree of concern, and perhaps taint the minds of those who might sit in judgment of Schuyler Barbeau, in a jury trial. Rest assured, there is no intention, on the part of the government, or media, of letting it, at that.

On December 11, 2015, King 5 news aired a segment in which they described as a “rare insight”, especially “in light of the terrorist attack in San Bernardino, last week, and other terrorist attacks across the country”, which raises a serious concern regarding Islamic Terrorism. That recently unspeakable phrase, which surely got the attention of the general public, most likely blinded or deafened to any of the above facts of the case, to date. As stated, the FBI is asking for the public’s help “in preventing the next act of terrorism.”

In that broadcast, the FBI begins by talking about “behavior that preceded the event”. They then suggest that certain individuals in the state may be in communication with ISIS, suggesting that Washington might see a brutal terrorist attack, in the near future. They are monitoring the behavior of those they have identified. Chris Ingles (King 5) suggests that Barbeau could be one of those cases the FBI had being speaking about. So, now they have classed this honorably discharged Marine/Soldier, a defender of the United States Constitution, in the same category as Islamic terrorists.

“[W]hen long trains of abuses and usurpations, pursuing invariably the same object evinces a design to reduce them under absolute despotism, it is their right, it is their duty, to throw off such government, and to provide for new guards for their future security.”

With those words, the War for Independence from British Rule began, in earnest. That Declaration of Independence is the premier founding document, for, absent the fortitude of those who supported it, with their lives, fortunes, sacred honor, and their willingness to die in the battle to contest the overreaching authority of British Rule, in violation of the British Constitution, the United States Constitution would never have been conceived. Instead, for the first time in the history of man, the people were the source of the authority that created the government.

Murder and theft, crime against people and property, are broken down into degrees of severity. That is the means by which certain crimes are graded, and punished, based upon the people assembled in a jury — so that the will of the people is supreme, and the government simply carries out the administrative function of the process of Justice.

What happens when the government enacts laws that make it a more serious crime to kill because of an emotion? They call them “hate crimes”, though they seem to be applied in only one direction. The result is that only a certain class of people can have harsher penalties applied, because the government says so, than if the killing was for money, jealousy, rage, or even random. Simply, the idea is to outlaw certain forms of thought (See Freedom of Speech and Thought Crimes). It is a form of social engineering, or more accurately, reconditioning to comply with the dictates of government’s control of not only our speech, but also our thoughts and actions.

Every state constitution, as well as the United States Constitution, recognizes that the creation of their respective governments, grants of authority, and limitations of power, are sourced from the people, themselves (“We the People”). It was presumed by the Founders that the authority of the people was such that they could, as so stated in the above quote from the Declaration of Independence, abolish a government that violated the limitations, and usurped authority, at the discretion of the people, not the discretion of the government. In fact, if you read closely, they even imposed the responsibility as a “duty”, to assure the perpetuation of the Great Experiment that they had initiated.

The FBI recently (August 20, 2013) published as an FBI Press Release, a description of the United States Code definition of Terrorism (Definition of Terrorism in US Code).

Definitions of Terrorism in the U.S. Code

18 U.S.C. § 2331 defines “international terrorism” and “domestic terrorism” for purposes of Chapter 113B of the Code, entitled “Terrorism”:

“International terrorism” means activities with the following three characteristics:

  • Involve violent acts or acts dangerous to human life that violate federal or state law;
  • Appear to be intended (i) to intimidate or coerce a civilian population; (ii) to influence the policy of a government by intimidation or coercion; or (iii) to affect the conduct of a government by mass destruction, assassination, or kidnapping; and
  • Occur primarily outside the territorial jurisdiction of the U.S., or transcend national boundaries in terms of the means by which they are accomplished, the persons they appear intended to intimidate or coerce, or the locale in which their perpetrators operate or seek asylum.*

“Domestic terrorism” means activities with the following three characteristics:

  • Involve acts dangerous to human life that violate federal or state law;
  • Appear intended (i) to intimidate or coerce a civilian population; (ii) to influence the policy of a government by intimidation or coercion; or (iii) to affect the conduct of a government by mass destruction, assassination, or kidnapping; and
  • Occur primarily within the territorial jurisdiction of the U.S.

18 U.S.C. § 2332b defines the term “federal crime of terrorism” as an offense that:

  • Is calculated to influence or affect the conduct of government by intimidation or coercion, or to retaliate against government conduct; and
  • Is a violation of one of several listed statutes, including § 930(c) (relating to killing or attempted killing during an attack on a federal facility with a dangerous weapon); and § 1114 (relating to killing or attempted killing of officers and employees of the U.S.).

* FISA defines “international terrorism” in a nearly identical way, replacing “primarily” outside the U.S. with “totally” outside the U.S. 50 U.S.C. § 1801(c).

So, just to get you thinking about the ramifications and the authority presumed by the government, but not granted by the Constitution, let’s look from the other side. If police use force to “influence or affect the conduct of [people] by intimidation or coercion, or to retaliate against [people’s] conduct”, then they, too, should be guilty of terrorism, especially when they are armed as an army, and protected against most means of assault by use of armor far more invincible than knights of old.

However, like hate crime laws, terrorism is a one-way street. The government cannot be guilty of terrorism, whether around the world, or within the States of the Union, any more than a White person can be the victim of a hate crime.

If we simply replace “prince” with “president”, and then evaluate whether we have reached that definitive point in our history, then we understand that there is a mandate from our source documents (the Declaration of Independence) that has, in effect, been outlawed by a despotic government.

Recent events have resulted in increased random shootings of police officers, around the country. Though the practice might not be deemed contemptible in one set of circumstances, it might be considered unjustified in the current situation.

Perhaps if we can separate what is acceptable and what is not, we can get a better grasp on what the variation in circumstances might warrant, as opposed to what is not warranted.

The shooting of police officers is a necessary consequence, when done with the proper circumstances, of forcing the government to submit to the will of the people, rather than the people submitting to the will of the government.

In light of both Waco and the Oklahoma City bombing, circumstances were different than those of today. Police force was exerted on the branch Davidians in Waco, resulting in the death of nearly a hundred men, women, and children — at the hands of law enforcement.

The Oklahoma City Bombing, conducted by Timothy McVeigh, was in retaliation for what he had experienced in Iraq and what he observed in Waco. Though we may not agree with his method, surely, his actions were directed at the source of the problem — an overreaching government.

Examples of the circumstances, in the nineties, are explained in two interviews I did at the time, Popping Cops and Breaking the Bonds of Slavery, the latter being more demonstrative of the justification of such actions.

However, the current circumstances, including both the events that lead up to the current furor and the significant change in the nature of law enforcement, have created a bit of a quandary. For example, if a cop is shot, the assumption, in both Mainstream Media (MSM) and the alternative media, will be that it is an act of retaliation for the deaths of Michael Brown and Eric Garner. This based upon the outrageous calling for killing any, and all, cops. Not that it would be outrageous under the proper circumstances, though that is lost in the current media hype, and there is little possibility of extracting an act against government from the story, if that were the motivation. Surely, the cops, if they caught the shooter alive, would sequester him so tightly that any story he had would never see the light of day. In addition, the presumption of retaliation would become the Prima Facie Story.

The perspective then would perhaps be “the right thing to do, for the wrong reason. It would place the patriot community in a position of supporting the “don’t shoot me, I’m black” crowd, without regard to the fact that black cops have shot both unarmed black and white people, and that most crimes, and killings, of blacks are by blacks.

During the sixties, the anti-war movement was intertwined with the black rights movement, placing the strictly “end the war in Vietnam” crowd with the mantle of black rights support or Women’s Liberation, though untrue to significant numbers of the anti-war crowd. They were stigmatized, by the press, into what they were not.

The same consequence is likely to occur, today, by tying the “restoration of constitutional government” group inextricably, to the “don’t shoot me, I’m black” crowd, which will co-join the two in the press, and might likely become a damper on, or destroyer of, the patriot movement.

However, there may be a solution — one that would provide a distinction, and also bring to light the fact that cops don’t discriminate because of color, when they kill unarmed people. They also kill unarmed whites, as well as other races, with the same impunity that they do when they kill blacks.

This past March (2014), Albuquerque Police Officer Keith Sandy shot and killed James Boyd, for illegal camping. Boyd was white, as was Sandy. However, there is complete video footage of the event, and leaves, without a doubt, the guilt on both Sandy, the other officers on the scene, and the entire police department that justified what can be called nothing but “murder”.

There are many that believe that Darren Wilson, who shot Brown, may well have been justified, as there had already been aggressive physical contact while Wilson was still in his patrol car.

When NYPD officer Daniel Pantaleo used a chokehold, or other restraint method, resulting, directly or indirectly, in the death of Eric Garner, the justification for Pantaleo’s action and the cause of death are not so clear.

Of these three events, the clearest, in terms of justification of the officer’s actions is Wilson/Brown event. Next, we have the murky events surrounding the Pantaleo/Garner incident, though this seems to be the motivation for the current outrage. Finally, we have the Sandy/Boyd event, where clearly there was no justification for the action resulting in Boyd’s death.

However, the motivation for the “kill the cops” effort stems from the event that seems to have the most justification (Garner), and is supported by the questionable, though newsworthy story (thanks MSM, Mayor de Blasio, and the Executive Branch). This is founded upon the Brown event (thanks MSM and the Executive Branch), and used to support the resulting attitude. While Boyd’s death, the least justifiable, is lost to MSM and the Executive Branch, and seems to only have recognition in the patriot community.

What would bring this into an acceptable realm for the patriot community? Surely, supporting the “kill all cops” attitude can only bring discredit upon us. It might also lead to a race war, as the black verses white issue is predominant.

What if we supported the police position? Well, would we then be supporting those who, by their nature, are not fulfilling their sworn duty to enforce the law, and would also be giving implied support for their killing James Boyd. This, too, might lead to a race war, as the cops are perceived as white — against the blacks.

Is there a position that we can, and should, support? There are two things that can be done to promote both by social/political action and by force that can have a positive effect for the patriot community.

First, we can hold the position that cops are not above the law, and only the people can determine what those limits will be. This can be accomplished by requiring that any time a person is shot, or otherwise physically abused, by a police officer, or any law enforcement officer, unless there is an active gunfight involved, that the matter go to a jury trial, so that the people, of the nation supposed to be governed with the consent of the people, determine whether the act was criminal, or not. That jury determination (not a grand jury where it is at the will of the US Attorney, State Attorney, or County Attorney) will set the standard for what is acceptable, and what is not acceptable, in the eyes of the local community — the local We the People.

Second, that any officer shot be one that is easily identifiable as having abused his authority (as in Sandy/Boyd), and warrants, without jury trial, as the evidence is so clear that guilt can only be ignored by obfuscation. The Internet provides many resources for the gathering of evidence sufficient to make such a determination (See Bad Cops and Targeting). This will have a two-fold effect on law enforcement. It will put those on notice who have not yet crossed the line, that there will possibly be consequences if they do cross that line. This might also lead them to want to distance themselves from those who have crossed the line. And, it will serve the effect suggested in Breaking the Bonds of Slavery.

NOTE: This interview was conducted over 16 years ago, and times have changed. It must be read in conjunction with “To shoot a cop, or, not to shoot a cop”, which will put a perspective of on this article, based upon circumstances today.

 I had a conversation with a friend the other day. It turned into a hypothetical scenario, and I decided that it might make a good interview. John agreed. So, what you are about to read is a scenario developed around what COULD have happened in Germany in the mid to late thirties, when some of the German people first began to suspect that Hitler’s Reich was a little bit different than what it was set out to be. Only portions of the interview are included.

OPF: John, how are you, today?

JOHN: Fine Gary, and ready to go.

OPF: Okay, John, why don’t you lay out the basis for the scenario, first.

JOHN: Okay, it is 1938 and some of the people have begun to realize that the government has continued to expand its power, increase its revenue from the people, and imprison those who defy the rules established in this progression of what amounts to a submission to slavery. Now, when I speak of people, I intend that to mean only those who have begun to understand the existence of the problem. The rest of the people I will refer to as “the rest of the people”. The scene, however, is not very much different than the conditions that currently exist in America, except that America has not chosen a scapegoat race to direct negative emotions at. America has selected a portion of the people to direct their negative emotions. But, that is not the story line, so, back to Germany.

OPF: So, suppose the people of Germany wanted to protect their country from what was, apparently, a step in the wrong direction?

JOHN: Well, I think it was more than apparent. Work forces of citizens, paid from the common treasury, were put to work with shovels, building the Autobahn, and other public works projects. Having been denied the right to build an Army after World War I, the government realized that they could build an army with shovels, and then replace the shovels with rifles. Close quarter drills, maneuvers, bivouac, the workforce practiced every type of military function. Nobody did anything about it. Most realized that the workforce was training to be an army. Once trained, and given the guns, the government had a police force sufficient to control all of the people. Of course, the local officials were brought in as a part of the military force, and took their orders from the central government, enforcing whatever laws the government passed. It was at this time that the people should have acted. The prosperity for the few who were willing to submit to the government, and enforce their laws, at the expense of the rest of the people, placed them in a position of power. This power was abused, in many cases, but the rest of the people took it, without question — or, at least, not aloud. This, though, would have been the time to strike. Many people still had their rifles and some may have had explosives. Heavy equipment had not been developed for smaller jobs, and so it was not uncommon for farmers and others to have explosives. Had they used these explosives on the government force, random hits by small groups, they would have had an effect.

OPF: You mean that they should have killed the soldiers and the police?

JOHN: Had they killed soldiers and police, in random acts, they would have created more than what was then just a reward scenario for the soldiers and the police. They were acting with impunity, and were fed and paid better than the average worker.

OPF: That would have been dangerous. Wouldn’t they most likely get caught and executed?

JOHN: Many were killed, anyway. Most, eventually, as soldiers in war. Others that resisted were captured and imprisoned, many to die in prison. I suppose that the difference is whether you want to die fighting, or just die. I believe that some of the Germans that I met years ago really regretted what they allowed to have happened. I think that they would have, had they thought that it would get as bad as it did, done something about it.

OPF: Well, what would be the desired result, had they done these random acts of killing?

JOHN: Probably. Most importantly, is that they would have created fear within the government. Kind of like when the Oklahoma City bomb went off. I remember that you had written an article (Escalation & Fear: Fear & Escalation) about how the government had reacted to the bombing. They were scared. From what I have read, very few of those who were in the building have been willing to go back to work for the government. Then, others, like Bob Ricks, from Waco, retired shortly afterwards.

OPF: You mean, the idea of killing people would have been to get them to quit their jobs?

JOHN: That would be fair to say. You know that burglar alarms are as effective as burglar alarm stickers. The burglars see the sticker, and they decide that there may be too much risk and move on to the next house. Likewise, if they think that there is an angry dog inside, they go elsewhere.

OPF: So, killing them is just to scare them?

JOHN: Not exactly. It has a number of other effects, as well. As soon as it started, there would be very few, if any, individual soldiers or policeman doing anything. They would change their uniform before going home, and whenever something had to be done, they would travel in large enough groups to affect their safety. This would reduce the number of active units that could be imposing on the people, or breaking in doorways. It would also have the effect of reducing, or culling the herd. Each dead or injured soldier or policeman would have reduced the force by one. His death would also have a greater impact on his friends, and cause them some concern for what they were doing. I’m pretty sure that they knew what was happening, and this might have just moved them enough to refuse to go along with it. But, this never happened.

OPF: What about the political leaders?

JOHN: Well, there is no doubt that they could have been targets, as well. Had, say, Goering been killed, then much of what he did might never have happened. Just think about the world today. Didn’t we try to kill Gaddafi and Hussein? Didn’t we kill Diem and then plant our man as leader of South Vietnam? Taking the political leaders out is, definitely, a political tool.

OPF: What about the Deutsches Bank and other institutions that supported the government?

JOHN: Well, there is a lot of support of any government by many institutions in a country. Some may already be influential and others may be seeking influence. They do so on the premise that if they favor the government, they will be favored by the government. The government realizes that it needs all of the support, both financial and industrial, to achieve its purpose. So, each is scratching the other’s back. If something was done to create a risk greater than the benefit, then I think that they would think differently. After all, they, like the government, need employees to do anything. Can you imagine how effective a government would be if nobody worked for it?

OPF: Now, you have suggested that small groups of people could do this and get away with it. Do you really believe that they could get away with it?

JOHN: There is always a risk. If they were to operate properly — say, a group of two to five people, like they call cells nowadays, planned everything, scoped the job, wore rubber gloves, kept their “work clothes” somewhere else, set up alibis, and really did their homework, I would think that only chance or bad luck would keep them from safely doing their job. The more groups there were, the more thinly they would spread their opposition. And, they would have been wise to have established escape plans, and means to communicate with their families, once the had to flee.

OPF: Given the Gestapo tactics, wouldn’t there be risk of being infiltrated?

JOHN: Yes, there is always that risk. There is also the risk of having someone that is not an infiltrator get caught at something else and turn against his friends to reduce, or remove his punishment for another crime. Remember, you wrote about Don Bunds in Waco, and then there was Michael Fortier. That guy Marshall in West Virginia, and many other cases where informants or infiltrators caused the destruction of even innocent activity — like the Viper Militia. To protect themselves from something like this, they should watch for a change in the nature or actions of one of their members. You’ve seen the old black and white movies where someone gives himself away by having to make a call, or sneaks out, or some other activity. Every caution would have to have been taken to keep Gestapo informants from infiltrating, and if suspicion existed, plans would have to have been changed, or, maybe, the member taken out. No trial, but the possibility of error rather than the risk of losing the cell. If cells had to communicate, only one member of any given cell would be known to any of the other cells. Only one man could go down that way. This guy would have to be chosen by the others as the most stoic. The Gestapo could be pretty cruel when they wanted to be. Eventually, as successes were achieved, I think that it would have become more open, just like in France. Major operations were conducted after the cells were tried and hardened. Their communication became more wide based, even to the point of the BBC broadcasting instructions to various groups via the radio. By then, the cells were hardened and the chance if infiltration was almost non-existent. Had that happened in Germany, there would not be nearly as many American graves across the European countryside.

OPF: When should the people have begun acting in this way?

JOHN: It probably never would have been too early — once Hitler gained power. I would think, though, that, depending on where you lived and what you had experienced, that the time to begin would vary based upon your experience. I would like to think that as soon as you knew where things were going, like so many do today in this country, that you would form your cell and act. As each cell began acting, it would motivate others to do so. Soon the risk would have become so great that the Reich may never have even begun its attempt to conquer the world. But, starting could never have been considered too late. If cells began when the Germans were being pushed out of France, it still would have been effective.

OPF: Well, John, thanks for your time. I suppose, if people do act when they know something is wrong, like the Founding Fathers did, that they can achieve what they want. Perhaps World War II could have been avoided. It is something to think about.

JOHN: Your welcome, Gary. I think you are right. Many will probably, like those Germans I told you about, regret that they did not act sooner. I only wish I was younger and, well, if I had been a German…

The Search Warrant has been made available, though the Arrest Warrant, if there ever was one, has not been produced. The Grand Jury Indictment is based upon first, demonization of Robert Beecher, then, on the evidence obtained from a search under a Search Warrant. Or, was it?

Understand that what you are about to read is not an uncommon occurrence in this country, today. You may well find yourself facing similar circumstances, under trumped up charges, or intentional misapplication of the law — as in this present instance.

This is going to be a difficult story to follow, since there are so many quirks and appearances of injustice, and impropriety, at least based upon the concept that we have been led to believe in — Innocent until proven Guilty.

We will break this down into six parts, though since we have no Grand Jury records, we can only discuss what went to the Grand Jury, not what they deliberated over. Those six parts are: Demonization of Robert Beecher; The Indictment; The Search Warrant; The Search; The Arrest; and, Possessing & Receiving.

Now, within this narrative, you will see what the government has presented to the Grand Jury, to obtain an indictment, and you will see what the Grand Jury did not see, that being the other side of the story.

Demonization of Robert Beecher

So, what did the government do to “demonize” Robert Beecher? In a “Full Investigation” opened on July 31, 2013, by FBI Special Agent Stanley H. Slater, (912) 764-6311 (Note: Call him at your own peril). The “investigation is being initiated based on Internet postings attributed to Beecher that indicate he is planning to commit violent acts toward federal government employees.” So, what someone said on the Internet is sufficient to open an investigation, unless, of course, you are a Negro and say “Kill Whitey”, or, a Muslim who says, “No Democracy, only Sharia law!” But, I digress.

From that investigation initiation report, we find:

Subjects Ryan Payne and Jerry Bruckhart are recruiting militia members throughout the United States to participate in a plan called “Operation Mutual Aid”. The plan calls for the kidnapping of a DHS agent in hopes of creating an incident that will cause other militia groups to take supportive action. Bruckhart has used the Internet to promote this plan and is the administrator of the Operation Mutual Aid website “operationmutualaidl.webs.com [no longer on line]”.

First, we’ll address something that my investigation has turned up with interviews with people who discussed that certain scenario. Some of them were associated with Operation Mutual Aid (OMA), others were not. At the time, it was discussed, fairly openly (on the Internet), and was not initiated by, or an objective of, OMA. I am still able to find reference to this activity, or bits of it, on the Internet. The scenario was that if DHS (or its subordinate agencies) were to clamp down and post roadblocks on all, or most, major highways, the objective was to “capture” a DHS agent and “escort” him to Washington and demand that the roadblocks cease, thereby proving that we could both “capture” and “escort” through the roadblocks, regardless of DHS’s efforts to control the people and their movement. It was an “IF” scenario. Though it may have been discussed on the OMA website (I found no reference there), it was not, by any means, within the Purpose of OMA, nor an OMA “operation”. The OMA Mission Statement has not changed since its inception, but the government seems to want it to be something other than what it really is.

Let’s look at the evidence that has, as you will see, been misrepresented to demonize Beecher to the Grand Jury. From alleged discussions on the then OMA website, the FBI cites the following, attributing them the Beecher, using the pseudonym “Stalker” (pseudonym confirmed):

“… I am ready to do what is necessary to remove this rogue government that has taken over our Country. I grew up Free and will die Free, I will never submit, or bend knee, to a corrupt government. Neither will I ask for mercy nor give it, once the Battle is joined.”

“The way I see it, to win this fight, we must fight like the insurgents. We must disable their communications and supply using hit & run tactics. There can be no more ‘I’m just doing my job’ passes given. We must destroy their support system which is the ‘little man’, without the ‘little man’ doing their jobs we can force the top to tumble, take their legs out from under them, so to speak. This means anyone working for the government. This would mean that anyone doing so would have to be mobile and willing to give up all comfort as they know it. A lot of 3-man Teams could accomplish what one large force couldn’t.”

Note that Beecher said, “…once the Battle is joined.”. Also note that there is nothing in the report that suggests kidnapping and torturing a DHS agent, as claimed in the court documents. Now, that is not a call for action, rather, a statement that he will defend the Constitution, if the government goes “rogue” — a reaction. Heck, if that is illegal, then they should be charging hundreds of thousands of people, if not many millions, who are apprehensive that government is approaching the level of “Despotism” mentioned in the Declaration of Independence — it is our “right” and “duty” to act to preserve our nation. After all, the oath to the Constitution that all military personnel take (Beecher served in the Army, 1971-73) pretty much requires that the Constitution be preserved. However, that doesn’t play well when you submit your “evidence” to a Grand Jury, seeking an Indictment.

Now, we all know that the government likes lists (I think it makes them feel like they are accomplishing something). It is their way of classifying us so that they know who, by their very words, might be extremely dangerous (unless a Negro or Muslim). On November 8, 2013, we find that the government has labeled Robert Beecher “Domestic Terrorism – Militia Extremist”. They have also entered him on the “Terrorist Screening Database” (TSDB) and the “Known and Suspected Terrorists” (KST) list. This, apparently, based upon the erroneous and grossly misrepresented information above. However, inclusion on those two lists surely plays well with the Grand Jury.

So, let’s continue reviewing the “excellent” work of those well-paid “Fidelity, Bravery and Integrity” people. In a report dated June 21, 2013, they provide even more “intelligence”, to wit:

FBI Salt Lake City identifies Robert M. Beecher as a possible associate/member of the West Mountain Rangers 41st Mountain Field Force militia group based out of Montana. This group has a plan identified as “Operation Mutual Aid” in which they want to kidnap a DHS agent in hopes of creating an incident which will cause other militia groups to take supportive actions.

Well, they knew that Beecher was working in Georgia, so I suppose they think he went to Montana on weekends to join a militia that is, well, only for Montanans.

So, if you want to go to a Grand Jury and get an indictment for a crime unrelated to the above, you surely want to get the above information before the Grand Jury, regardless of the veracity of the information, so that the Grand Jury will know, before they evaluate any other information, that Robert Beecher is a despicable person, ready to kidnap and torture government agents, though he never left home or the surrounding area, in Georgia, for the period from the original investigation (July 31, 2013) to the date of the Grand Jury Indictment (June 4, 2014). They claim he was part of a Montana Militia and was conspiring with people in Montana (Payne) and Pennsylvania (Bruckhart), in open forums on the Internet, to commit these evil deeds, though they offer no more tangible proof than what is mentioned above — that aren’t even charges in the Indictment. However, that is the foundation laid before the Grand Jury, to assure Indictment on far lesser, and as will be explained, bogus charges.

The Indictment

The Indictment, duly signed by the Grand Jury Foreman and four members of the Department of Justice, show us the heinous crime, if it is, in fact a crime (See discussion of Possessing & Receiving), the has been manufactured by three government employees (DOJ, FBI, and BATF):

who before that time had been convicted of a felony offense, an offense punishable by imprisonment for a term exceeding one year, did unlawfully and knowingly possess, in and affecting commerce, a firearm, that is, one Marlin .30-30 rifle, Model 336, serial number 231106294, which had previously been transported in interstate commerce, in violation of 18 U.S.C. §922(g)(1).

COUNT TWO

(Possession of Firearm by a Convicted Felon)

THE GRAND JURY CHARGES THAT:

On or about May 7, 2014, in Tattnall County, within the Southern District of Georgia, the defendant,

ROBERT BEECHER,

who before that time had been convicted of a felony offense, an offense punishable by imprisonment for a term exceeding one year, did unlawfully and knowingly possess, in and affecting commerce, firearms, that is,

one Marlin 30-30 rifle, Model 336, serial number 231106294,
one Remington .22 caliber rifle, Model 597, serial number A2666353, and
one Hi-Point .45 caliber pistol, Model MP, serial number 460571,

all of which had previously been transported in interstate commerce, in violation of 18 U.S.C. §922(g)(1).

               A TRUE BILL.

Now, I have trouble understanding legalese, but I do understand words. So, if I read this carefully, I see that in both Counts, he is charged with possessing “one Marlin .30-30 rifle, Model 336, serial number 231106294”. Except for the dates, the charges for that rifle are identical. So, we can conclude that dating the pictures (captions provided below) gave them, for Count One, dates of February 5 – 15, 2014, and for Count Two, May 7, 2014. So, if you get a Count for each occurrence of possession, why not give a Count for each day in between, if in fact Beecher did Possess such a weapon. This possession, however, will be discussed latter. However, we can conclude that the pictures played a role in the evidence submitted to the Grand Jury.

You might also note, for future reference, the phrase in both Counts, “did unlawfully and knowingly possess, in and affecting commerce, a firearm“. This, too, will play a very significant role in the subsequent discussion.

I will point out here that some of the court documents make a point of showing the expansive experience and training that some of the agents have acquired, over the years, which is used to conclude that the weapons in question were, in fact, manufactured in a state other than Georgia. Those same documents show that Jessi purchased the mentioned “Marlin .30-30 rifle, Model 336, serial number 231106294”, which raises the question of possession, which will be addressed, later.

Search Warrant

Now, we move on to the “Affidavit in Support of Application for Search Warrant”. The information I have has no date on the Affidavit, though it is prepared by Special Agent Lorin Coppock, Bureau of Alcohol, Tobacco, Firearms, and Explosives (BATF when they raided Mt. Carmel Church, Waco, Texas). He lists his experience, including Deputy Sheriff and BPS, and then begins presenting his “evidence”. He, apparently, had an informant who logged into Beecher’s Facebook account and then allowed investigators to view Beecher’s Facebook account and access the pictures on Beecher’s page. Though I don’t have the pictures, by the captions and other information in the Affidavit, Beecher is apparently seen in thirteen pictures holding, or near, a weapon (rifle or pistol). The Affidavit then describes both III% slogans and memes that are commonly circulating through Facebook, on hundreds of pages. There is also reference to “Molon Labe” (Come and Take It), which, as was explained above regarding his statements in the discussion on the OMA webpage, purely defensive. Then, as absolute proof of his nefarious activity, it shows that Beecher is a member of a Facebook group, “Central Ga Guns & Ammo Trader”.

SA Coppock then talks about his experience and knowledge that people who own firearms, hold them for “lengthy periods of time and store them in their residence or vehicle”. That is a rather interesting revelation.

Though the copy of the Affidavit that I have obtained had poor quality photographs, the captions are, in themselves, telling (underline, mine):

  • On February 15, 2014, Jessi Winkler posted a photograph to Beecher’s Facebook account. Winkler captioned the photograph “With Robert Beecher III”. The photograph is of Beecher sitting on a couch holding what appears to be a Marlin 336 rifle.
  • b) On February 15, 2014, Winkler posted another photograph of Beecher holding what appears to be the same rifle. In this photograph Beecher is outside leaning over a box-like structure in a braced firing position. The caption for this photograph is “Target practice-with Robert Beecher III”. Beecher added a comment to the photograph which reads “Best present ever. Im glad this was shot from the back or I’d have been embarrassed”
  • c) On January 7, 2012, Beecher posted a photograph of a small child holding a candle standing next to what appears to be a Rossi single shot rifle. Beecher captioned the photograph “I light the candle, he blows it out. I just love a Saturday morning with him…” Beecher later added the comment “For the record: That is my Grandson’s (Aidan) .22 single shot rifle. Alex was dragging it by the sling earlier, its now secured…”
  • d) On February 18, 2012, Beecher posted a photograph of two boys outside. One of the boys is holding what appears to be a Rossi single shot rifle while the other is holding what appears to be a BB gun. Beecher captioned the photograph “10 year old shooting-in Riverridge, GA.”. Beecher later added the comment “1 let this one try a .20 gauge, He went back to the .22. This is the future…”.
  • e) On February 18, 2012, Beecher posted a photograph of the same two boys. One of the boys is holding what appears to be a single shot Rossi rifle and the other is holding what appears to be a BB gun. Beecher captioned the photograph “More practice”. Clearly visible in the background of this photograph is a house that has been identified by your affiant as Beecher’s residence.
  • f) On October 20, 2012, Beecher posted a photograph of a child holding what appears to be a Rossi single shot rifle. One of Beecher’s “friends” posted a comment about the child’s finger ‘being on the trigger of the rifle when the photograph was taken. In response Beecher posted the comment “I corrected it. He checked to make sure it was unloaded after picking it up. That was a good sign he listens…”
  • g) On March 29, 2013, Beecher posted a photograph of a child sitting on a tree stump holding what appears to be a Rossi single shot rifle. Beecher captioned the photograph “Guard Duty”. One of Beecher’s “friends” posted the comment “CPS be looking into this, hope the kid has good aim! You teaching them right gpa!” In response Beecher commented “CPS will be stepping into a Hornet’s Nest they come out here telling me how to raise my Grandson…”
  • h) On April 26, 2013, Beecher posted a picture of three children in a wooded area. One of the children is holding what appears to be an AR-15 rifle. Beecher captioned the photograph “Aldan took the rifle, fight time…-at Beechers.”
  • i) On April-26, 2013, Beecher posted another picture of the same child holding what appears to be an AR-15 rifle. Beecher captioned the photograph “He won’t put it down. I never argue with a kid holding a rifle…-at Beechers.”
  • j) On March 31, 2013, Beecher posted a photograph of a baby sitting on the floor inside a house. In the corner of the room is what appears to be a scoped rifle leaning against the wall. Beecher captioned the photograph “Max hopes everyone has a Happy Easter”.
  • k) On April 29, 2013, Beecher posted a photograph of a baby sitting on the floor inside a house. Directly behind the baby is what appears to be the stock of a rifle or shotgun that is leaning against the wall.
  • l) On June 9, 2013, Beecher posted a photograph of a child leaning over a table looking toward the person taking the photograph. Beecher captioned the photograph “Papa. Papa. Papa. I want to shoot my gun.”
  • m) On April 5, 2014, Beecher posted a photograph of a young child inside a home next to a dining table. Hanging on one of the chairs at the table is what appears to be a shoulder holster containing a pistol. Beecher captioned this photograph “Someone came to play with Papa…”

Note the effort to instill concern because there are children around the firearms? I doubt that the Grand Jury would over-look this with an understanding that firearm safety should be taught at home, by family.

He then points out that two of the firearms he was able to identify in the photographs on the Facebook page, a Marlin rifle and a Rossi rifle, are not manufactured in Georgia. Now, it begins to get interesting, at least in context to timing of events. The Affidavit resulted in the issuance of a Search Warrant signed on May 6, 2014 at 2:32 P.M.

When Coppock describes the “Items to be Seized”, he begins with:

Based upon the aforementioned facts, I believe probable cause exists that the following items listed in Attachment B, which constitute evidence of violations of Title 18, United States Code, Section 922 (g) (1) will be found at the location to be searched. The items listed in Attachment B constitute contraband, evidence and/or instruments of the aforementioned offenses. (Attachment B is the Affidavit, complete with pictures.)

Wait a minute! He said that he needed the warrant and to search for these items to provide “evidence… of the aforementioned [18 USC 922 (g) (1)] offenses. Doesn’t that imply that they need more than pictures to get an Indictment? They have to find proof that an “offense” has committed.

Well, if the Warrant was issued on May 6, at 2:32 P.M., and the Warrant was executed on May 7, 2014 “at approximately 2:00 P.M.” Then they didn’t have the evidence necessary to bring charges against Beecher until after they verified that the weapons actually existed as “evidence… of the aforementioned offenses.” The search was not completed until nearly 5:00 P.M.

However, Beecher was first detained at work on May 7, 2014 at about 3:00 P.M. (See “Arrest”, below) — before the Search was completed. It sure appears to any observer that there was a presumption of guilt the led to the arrest, and then an effort to find “evidence… of the aforementioned offenses.” Rather backward, and contrary to the intent of the Framers of the Constitution and the concept of: “Innocent until proven guilty.”

Now, the Fifth Article in Amendment to the Constitution says, “No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury.” “Held to answer” means arrested and charged with something that you will have to answer to, in court. However, the Indictment (for arrest?) was filed by the Grand Jury on June 4, 2014, though the arrest occurred on May 7. Further, there is no record of an Arrest Warrant ever having been issued. So, hasn’t the government got the cart before the horse? Or, perhaps more likely, “cart attached; horse to follow.” Or, is it possible that the FBI Academy (as well as the BATF equivalent) failed to include a course on the Constitution — “just take the oath, we know you know that the law is what you say it is”.

The Search

Robert lives in an RV parked on Cindy’s property. Cindy lives in a house on a 0.6-acre parcel. The address of the house is the address on the Search Warrant. Being divorced, they live separate lives, though they are still on friendly terms, occasionally playing cards, watching a movie, or playing with the grandchildren, most often at Cindy’s house. However, whether Cindy goes to Robert’s home, or Robert goes to Cindy’s home, the visitor is a guest in the home of the other. The only thing shared is the mail delivery address.

May 7, 2014 about 5:00 P.M. When Jessi arrived at her mother, Cindy’s, house [JL]:

The living room, kitchen, and bathroom were fairly decent, but the three bedrooms (the master, the kids’ room, and the guest room/computer room) were absolutely trashed. A window unit AC was lying on my mother’s bed, her bedspread torn off, jewelry dumped out, closets emptied. In the kids’ room, everything from the closet was strewn around, and the same with the computer room. I never went into the RV [Robert’s home] but my mother said it was destroyed as well. My husband and I cleaned up the shed [Cindy’s] ourselves, and it was a complete wreck.

No surprise that the government, in acquiring evidence of an atrocious crime such as holding a firearm, warrants such destruction of property that doesn’t even belong to Robert Beecher.

The Arrest

The arrest of Robert Beecher deserves a detailed explanation, both as how the government operates and as a lesson on what to expect if you are ever confronted by lying government agents. We will repeat some of the elements of the timeline, so that a proper perspective can be put on what went down. Timelined events are factual, based upon documents in my possession. My commentary will be in separate paragraphs. This information, except the FBI interview report, was not presented to the Grand Jury.

May 6, 2014 at 2:32 P.M. – Search Warrant signed

May 7, 2014 at 2:00 P.M. – Search Warrant executed (search begun)

May 7, 2014 at about 3:00 P.M. – Beecher ‘detained’ by Agents Slater (FBI) and Coppock (BATF).

This is based upon letter from Jessi Winkler (Robert’s daughter) to OPF. Jessi has an accurate timeline based upon times logged on her phone. At 4:01 P.M. she received a call from her mother (Cindy, Beecher’s ex-wife) saying that Robert’s boss had called her and said that the FBI and BATF had taken Robert away about an hour before. There are no available government records to substantiate this. A letter from Robert [RL] to OPF explains that the agents informed him that he was “not under arrest, that they needed to talk about some things and asked if [he] knew Jerry Bruckhart at OMA” (See “No bended knee for me” – the Persecution of Robert Beecher).

Now, I know that sounds self-serving — to claim that he was told that he was not going to be arrested. This same “set-up” happened to Ron Cole, back in 1997. However, the FBI, in their own Interview Report [FBI], tell us:

Beecher was asked if there was anywhere else private to talk. Beecher suggested talking in the parking lot near the business and began to walk toward where SA Coppock’s vehicle was parked. SA Coppock suggested talking in his vehicle and Beecher agreed. SA Coppock sat in the driver’s seat, Beecher sat in the front passenger’s seat and SA Slater sat in the middle of the back seat. Once inside the vehicle SA Coppock advised Beecher that he was not put under arrest and was free to leave at any time.

However, again according to the FBI, this about two-thirds of the way into the printed interview [FBI]:

At this point in the interview Beecher noticed SA Coppock and a uniformed Toombs County deputy walking around the front of SA Coppock’s vehicle toward the passenger’s side. Beecher turned back around toward SA Slater and asked if he was going to be arrested. Beecher was informed that he was going to be arrested for being a felon in possession of firearms.

This portion of the interview occurred at Beecher’s workplace. Considering the amount of information discussed, that would probably come close to an hour after the original detention. They then left the Leprechaun Car Wash, in Vidalia and took Beecher to the Tattnall County Jail. This is about 20 miles and 23 minutes, according to Google Earth. That would put the arrival at the Jail, at earliest, at 4:00, though more likely about 4:30 (the record reflects very few times).

Once they arrived at the Jail, we find this in the interview [FBI]:

Beecher was led into the conference room of the Tattnall County Sheriff’s investigator’s office. Beecher was advised of his rights with a BATFE Advice of Rights and Waiver form. Beecher signed the form and agreed to continue talking with Agents.

So, Beecher signed the form AFTER they arrived at the jail. The form (ATF form 3200.4) does bear Beecher’s signature, and it is witnessed by BATF SA Coppock, who dated and signed the form as a witness, “5/17/14 3:03”. Beecher later commented that the time was in error (See May 7, 2014 at 4:37 P.M., RL), and we must agree with him. The original detention occurred, at best, no earlier than 3:00. Then we have the initial interview, conducted in SA Coppock’s car. Later, they went to the Tatnall Sheriff’s Office and then Beecher signed the waiver. At the earliest, around 4:00, more likely later. However, by making the “official record” show that it was signed about the time of the original detention (3:03), it would mean that everything discussed prior to the waiver could be included on the record, and fair game (“can be used against you”). However, considering the apparent low IQ of most government agents, lying both about not arresting Beecher and about when he signed the waiver, it is not difficult to understand that they were stupid enough to leave the proof of their perjury in the written evidence.

You should find it outrageous that the FBI (or any government agency) can lie to the people, yet they impose criminal penalties on the people, if they lie to the government agents (See 18 U.S. Code § 1001 – Statements or entries generally), the people can be fined and/or imprisoned, though the government agents are immune from such penalties.

Jessi, being closer to where Robert was taken, attempted to find where he was detained. She was told at both the Tattnall County Sheriff’s and the Reidsville Police Department that he was not being detained at either facility. After over half an hour, and numerous phone calls, Jessi found that Robert was being detained in a building behind the Sheriff’s Office. We can let Jessi’s words speak for themselves:

May 7, 2014 at 4:37 P.M. [JL]:

Jessi drives up towards the Sheriff’s office. There are two buildings located behind it, and as she asks a deputy outside of one where the proper one is, he points to the second one and she sees two men standing outside of it [Agent Slater and Agent Coppock].”

At this point, I pulled up and parked outside the proper building, and the agents introduced themselves as soon as I exited my car. We spoke for about five minutes or so. They discussed Dad’s militia and patriot group ties, told me that he had “great historical knowledge” of the III% movement, and that they were hoping he could help them out. I asked them what the charge was and they mentioned the felon in possession of a firearm, and also a possibility of conspiracy. I asked them what kind of time that would bring, and Coppock told me that it was a maximum of 10 years. At that point, Agent Slater spoke up and told me that while he didn’t think my father was dangerous, and that he seemed more of a patriotic prepper, he also believed that my father knew people who were dangerous. He blathered on about how my father might not want to hurt people, but how he could let them know who would, and how those people were dangerous to the cause my father believes in.

I was told that if he would cooperate, and give them some solid information, that it could play in his favor. I asked them what he meant by that, and Coppock told me that since Dad was 60, had a clean record for the past two decades, and since none of the guns were high-capacity assault rifles, but rather hunting rifles, that he could be looking at a slap on the wrist. His expression and tone made it clear that nobody would push hard for hard time based on the rifles found. Slater told me that it would be helpful if my family and I would help pressure Dad into cooperating, to tell him that his grandchildren needed him to stay home. At this point, we went inside the building where I saw my father.

He was handcuffed, but he smiled and joked a little with me about the whole situation. I asked for permission to hug him, and when they gave it to me, I hugged him and whispered ‘What should we do?’ He told me to not say anything, that I didn’t know anything, and that the guns were a bullshit charge. This is when he first mentioned the threat to arrest me in a roundabout way because he said ‘I’m not going to let them do this to you.’ He told me not to tell anyone other than Sean [Jessi’s husband] and my sister for the next few days, until he had a better grip of what they were wanting and what was going on. I had about five minutes with him before two officers took him away to take him to Savannah.

The agents gave me his belongings in a large Ziploc bag, and again told me that we should pressure him into cooperating, and that he could walk away from this if he did. They also told me to keep his arrest quiet since he couldn’t provide valuable information if everyone knew he was arrested. I told them I wouldn’t say anything (since my father had instructed me not to), but that if they didn’t get my Dad out on bail fast it was a moot point since he is very active online, and people would notice his absence very quickly. They said they would see what they could do.

This is corroborated by Robert’s [RL] statement:

I was questioned about various people involved in different groups and organizations. I kept telling them I wasn’t familiar with the names, and that because I dealt with a lot of people in different parts of the country, some with the same first names, that I was unsure of who they were talking about. Again I was told that if I helped them that they would help me, that they could help me get released if I helped them. Around 4:30 they read me my Miranda rights. [This statements refutes Coppock’s time of 3:03]

The important thing for people to understand is that if they did this to me, how many others have been snatched and agreed to inform? Good people, but outside their limits dealing with lying ass federal agents?

Conveniently, however, there is no mention of an effort to “turn” Beecher into an informant, though they do admit to asking him about some groups and some individuals.

May 7, 2014 at about 5:03 P.M. – [JL] …two agents came into the building, and from their conversation it was clear that they had just returned from searching my mother’s house. They were basically asked by Slater/Coppock if there had been any problems with the search.

This would put the completion of the search well after 4:30. Recall that the Search Warrant was granted because “The items listed [if found] constitute contraband, evidence and/or instruments of the aforementioned offenses.” So, the earliest time that they could even begin to suggest that there was evidence of alleged crimes would be at the completion of the search, or at least 1 1/2 hours after he was first detained — without an arrest warrant. Now, let’s look at:

Receiving & Possessing

Though I addressed this aspect of the charges in “No bended knee for me” – the charge against Robert Beecher, seeing the Indictment and reading the Affidavit, gives us even more to contemplate.

The statute, 18 USC 922 (g) (1), clearly states that:

It shall be unlawful for any person… who has been convicted in any court of, a crime punishable by imprisonment for a term exceeding one year… [1] to ship or transport in interstate or foreign commerce, or [2] possess in or affecting commerce, any firearm or ammunition; or [3] to receive any firearm or ammunition which has been shipped or transported in interstate or foreign commerce.

Now, the Code of Federal Regulation (CFR), is titled, 27 CFR 478.32 – Prohibited Shipment, Transportation, Possession, or Receipt of Firearms and Ammunition by Certain Persons:

No person may ship or transport any firearm or ammunition in interstate or foreign commerce, or receive any firearm or ammunition which has been shipped or transported in interstate or foreign commerce, or possess any firearm or ammunition in or affecting commerce, who… [then lists elements that would preclude]”

Note the subtle difference between the two wordings. In Title 18, the shipping and receiving are separated by the “in or affecting commerce”. However, in 27 CFR, the wording ties the first (shipping) with the second (receiving), then goes on to “in or affecting”.

There is one more ‘writing’ that might tend to mislead. It is found in the Indictment, and most likely the chicanery of the US Attorney (probably AUSA Carlton R. Bourne, Jr.) in suggesting contrary to the law, itself, when they cite “Possession of Firearm by a Convicted Felon”, in a very general sense, in identifying the charges. Titles, however, are not laws. It is the specific wording of the law that makes an act criminal, or not. And, we know that the government would never, ever, lie or try to mislead us — or the Grand Jury.

So, let’s look at the pertinent definitions of the words used in the statute [definitions from Black’s Law Dictionary – Fifth Edition]:

Possess: (pertinent parts)
To occupy in person; to have in one’s actual and physical control; to have exclusive detention and control of; to have and hold as property; to have a just right to; to be master of; to own or be entitled to.

Possession: (pertinent parts)
The detention and control, or the manual or ideal custody, of anything which may be the subject of property, for one’s use and enjoyment, either as owner or as the proprietor of a qualified right in it, and either held personally or by another who exercises it in one’s place and name. Act or state of possessing. That condition of facts under which one can exercise his power over a corporeal thing at his pleasure to the exclusion of all other persons.

Receive: (pertinent parts)
To take into possession and control; accept custody of; collect.

Now, common sense, a rather rare commodity, can also come into play, here — though probably not to the well-paid public servants (Slater and Coppock), and the US Attorney that will be prosecuting this case. That common sense has to do with the concept that words have different meanings, or we wouldn’t need different words. (This subject was addressed, to some degree, in a previous article – ‘No bended knee for me’ – the charge against Robert Beecher.) However, we will broaden the previous discussion, so that we can understand what the intent of the law is, verses the application in this current matter.

The statute has three parts, each of which defines an activity that is “illegal” under the statute. The first part is “No person may ship or transport any firearm or ammunition in interstate or foreign commerce“. This says that a “felon” may not ship or transport in interstate commerce. Commerce is commercial enterprise, it is not a person moving, vacationing, or just traveling, between states. That is a right and is excluded from the even overly-broadened federal definition of commerce.

The next provision is “to possess in or affecting commerce“. This agrees with the previous provision in that it makes clear that the possession has to be “in or affecting”. One would have to be involved in commerce, or doing something that affected commerce, to satisfy this provision. The relationship would have to be direct. Simply because the firearm were transported, in commerce, at some prior, or subsequent, date, does not affect the person that possess a firearm totally unrelated to the commercial aspect of its transportation.

Finally, we arrive at “to receive any firearm or ammunition which has been shipped or transported in interstate or foreign commerce“. This might appear to be inclusive of the receipt of a firearm or ammunition that had, somewhere along the line, been shipped in interstate commerce — unless we look at the word “receive”. By the definition of receive, “to take into possession and control; accept custody of; collect”, it appears that it must be tied to the transporting, as in that instance, one would collect or take into possession. Could it be that one would have to trace the entire history of the firearm before he acquired it, to assure that it had not, ever, entered interstate commerce (which would include leaving the state of manufacture and then returned to that state, via commerce in either direction), before you could rest comfortably in acquiring a new firearm? It is insane to think that one would have to trace the entire history of a firearm, and failing to do so could result in imprisonment for years. However, it is understandable, though perhaps not constitutional, to prohibit felons from involving themselves in the exercise of transporting, carrying, or receiving, directly, through interstate and foreign commerce.

Although one mayhave exclusive detention and control of; to have a just right to; to be master of; to own or be entitled to” does not mean that it applies to possession other than in commerce. If one were to avoid the application of this law, he would have to purchase only firearms and/or ammunition that was manufactured within the state where he resided. If one, the other, or nether, were manufactured in his state, he would be denied the right that is protected by the Second Amendment, and denied what another, in another state, is not denied. That is not an equally applied law — equal justice under the law.

The problem is compounded if he chooses to move, for whatever reason, to another state. Property that he might have lawfully (federal law) owned in one state would, upon crossing the state line, make him a criminal as he entered the next state — if such a move were deemed “commerce”. It would deny him the protection provided for in Article I, §2 of the Constitution, “The Citizens of each State shall be entitled to all Privileges and Immunities of Citizens in the several States.” His privilege to own a firearm would, instantly, be denied, and immunity from prosecution would, simply disappear.

Conclusion

What we might want to consider, however, since they were not going to arrest Beecher, and the warrant was to get evidence to support the possibility of a crime, we might deduce that the decision to arrest was a result of the interview. First lesson, do not talk to officials. They will lie about when you signed your waiver of Miranda, and can, since cops never lie, use everything that they learned from you, against you. During the course of the interview, Beecher admitted that he had some guns. Was that the kicker that allowed them to arrest, without the vital evidence sought via the warrant? Quite often, if they can get you relaxed, you might be surprised at just what you might say without realizing that you have given something that you should not have — and that might be misconstrued, resulting in a possible conviction — just because you thought you might be able to talk your way out of it.

The other possibility rests on the arrest, which appears to have been preplanned, was a result of the pictures — sufficient in their mind to determine guilt. What can be determined by a picture showing someone holding a firearm? Does it prove possession, or receipt? Or, is there something else that just might be the truth of the matter? Suppose you have gone shopping with your wife (or any other person) and they ask you to hold their purse while they, say, hold a blouse up to see what it might look like on them. Do you “possess” the purse? Or, are you simply holding it? Suppose that someone said, “look at this rifle I got for Christmas”. They hand it to you. Do you possess it, or receive it, or are you only holding it to observe it?

Compare these circumstances with the intent of the law, using the legal definitions, not the everyday definitions we might attribute to those words. The law is based on specific definitions for specific words. It has to be that way, as our use of language often doesn’t warrant the specificity that the correct interpretation of a law does. If having something in your hands, in a temporary situation, whether holding the purse or looking at someone’s new toy constitutes the legal definition that sets the standard to justify indicting someone for an alleged crime, then it would be a crime. However, if it does not meet that standard, then, surely, no crime has been committed.

However, if we look at this whole situation in context, it appears that the entire effort of the government was to turn Robert Beecher into an informant (See Informants Amongst Us?), as they tried to do with Randy Weaver — costing the lives of a U.S. Marshall, Randy’s wife and 14 year old son. Then we need to determine that that definition of Despotism that was written into the Declaration of Independence has been fully met by the current government, and that the solution is not in government, rather, in the hands of We the People.

Government should not be theoretically defensible,
it should be the object of general acceptance.
